    弊社は、適宜お客様に通知することなく、本ウェブサイトに掲載し、又は本ウェブサイトを通じてお客様に入手可能となっている製品、サービス並びに/又はそれらの機能及び仕様を、お客様に通知することなく(永続的又は一時的に)変更、修正又は終了にすることができ、また、弊社はこれらの製品及びサービスの価格につきましても変更することができます。弊社の販売条件にも、弊社が本ウェブサイト上で販売している製品を変更及び/又は終了する条件が明記されております。現在の販売条件はwww.loropiana.com.においてご確認ください。

    弊社は、正確かつ定期的に右の情報を本ウェブサイト上にてご覧いただけるよう合理的な努力をいたしますが、弊所はウェブサイト上の情報(製品に関する表記、価格や在庫を含みますがこれに限定されません)に関する正確性、完全性及びそれが最新のものであることについて適用される法律に従って可能な限度において何らの表明又は保証もしないこととします。本ウェブサイト上へのいかなる製品又はサービスの掲載は、お客様が当該製品のご注文を希望された場合又は当該サービスの利用を希望されたいかなる時点においても、当該製品の在庫があること又は当該サービスが利用可能であることを示唆、保証又は約束するものではありません。弊社は本ウェブサイト上にて可能な限り正確に弊社製品のカラーを表示するよう努力してきました。しかしながら、実際にお客様がご覧になるカラーはお客様のPCの設定に依存するところがあり、弊社においてお客様のPCが弊社製品のカラーを正確に表示していることを保証することはできません。

    お客様は本ウェブサイト又は本ウェブサイトへのネットワーク環境の脆弱性の調査、スキャン又はテストをすることができず、また本ウェブサイトのセキュリティ基準又は認証基準に違反することもできません。お客様は本ウェブサイトをご利用の他のお客様の情報をたどるため、又は本ウェブサイト、サービス若しくは本ウェブサイトの情報をご利用するためにルックアップ、トレース又はシークを保存することはできず、また、違法目的、当該利用規約により認められていない目的、違法行為の誘発又はその他ロロ・ピアーナ若しくは第三者の権利を侵害する行為のために本ウェブサイト又は本コンテンツを利用することはできません。

    お客様は本ウェブサイト、システム、又は本ウェブサイトに接続されるネットワークの設備に不合理かつ不釣り合いに大きな負担をかけるような行為をすることができません。お客様には本ウェブサイトの適切な運営、本ウェブサイト上で行われる取引又は他のお客様による本ウェブサイトのご利用を害するようなデバイス、ソフトウェア又はルーティンを利用しないことに同意していただきます。

    登録及びアカウント

    CHAT

    ロロ・ピアーナはお客様がLiveChat!のサービスをご利用できるよう随時作業を進めておりますが、LiveChat!はセール期間中、セール終了後、及び本ウェブサイトの閲覧中のお客様をサポートすることを目的としております。LiveChat!をご利用になる方はお名前(又はニックネーム)及びEメールアドレスをお送りしなければなりません。LiveChat!は詐欺行為、違法行為、加害目的で利用することはできず、また、ロロ・ピアーナやロロ・ピアーナの活動、評判、従業員、他のお客様又は第三者に対して損害やそのリスクを与えるような方法で利用することもできません。ロロ・ピアーナはLiveChat!が不適切な方法で使用された場合には、その提供を一時停止又は中断することができます。

    プレス専用エリア

    プレス専用のエリア(以下「プレスエリア」といいます。)が本ウェブサイト上にてご利用可能になります。プレスエリアへのアクセスは、ジャーナリスト及び承認を受けたユーザー(以下「承認済ユーザー」といいます。)のみに認められ、登録が必要となります。本ウェブサイトのホームページにある「プレスエリア」ボタンをクリックすると登録フォーム画面にかわり、お客様はそこでプレスエリアご利用の登録をすることができます。必要事項をご記入した上で登録フォームをオンラインで提出してください。お送りいただいた情報を弊社にて確認し、弊社のみの判断にてプレスエリアへのアクセスを承認するかどうかを決定させていただきます。プレスエリアへのアクセスが承認された場合には、登録フォームにてご記入いただいたお客様のEメールアドレス宛に、仮のログイン情報、仮のパスワード及びプレスエリアへのURLリンクが記載されたEメールを送信させていただきます。プレスエリアのページを最初に開かれるときに、お客様の登録情報により詳細な個人情報を追記していただき、仮のパスワードの変更が要求されます。プレスエリアへのアクセスが承認された場合、掲載されている資料につき法律により認められる範囲でアクセス及びダウンロードをすることができます。弊社はお客様が関心のある資料及び情報につき検討することができます。弊社は以下の場合には事前の通知なくして、いつでもお客様のアカウントを削除することができます:(a)お客様が当該利用規約に違反してアカウントを使用していると弊社が合理的に判断した場合、(b)第三者がお客様のアカウントをお客様の同意なく使用していると弊社が合理的に判断した場合、又は(c)セキュリティ又はメンテナンスの目的で弊社がお客様のアカウントを停止若しくは一時停止する場合。

    免責条項

    本ウェブサイトのご利用についてはお客様のみのリスクにおいて行っていただき、お客様にて本ウェブサイト並びに第三者のコンテンツ及びウェブサイトのご利用について責任を負っていただきます。ロロ・ピアーナは、本ウェブサイト及び本コンテンツにウィルス及び不具合がないようにするために必要なすべての合理的な手段を講じますが、お客様のPCの備品、ハードウェア、ソフトウェア又はこれらに保存されている若しくはこれらによって作成されたデータ(以下総称して「備品」といいます。)が本ウェブサイト又は本コンテンツにアクセスしたことにより毀損、破壊、消失その他の影響を受けないことについて保証することはできません。さらに、ロロ・ピアーナは本ウェブサイト、本コンテンツ又は本ウェブサイト上のサービス若しくは機能が中断されないこと、不具合が改善されること又はお客様による本ウェブサイトのご利用が特定の結果を生じさせることについての保証もいたしません。

    本ウェブサイト及び本コンテンツは現状有姿のままで可能な限度おいて提供されます。法律上認められる最大限の範囲において、ロロ・ピアーナは正確性、完全性、非侵害性、商品性又は特定の目的に対する適合性に対する保証を含む明示又は黙示のすべての保証について免責されます。ロロ・ピアーナは、お客様による本ウェブサイトのご利用に関係する第三者の作為又は不作為に関する名誉棄損、知的財産権侵害、プライバシー、わいせつ、又はその他の法領域における刑事又は民事上のすべての責任(本ウェブサイト上の第三者のコンテンツ、情報、記載、利用に対する責任が含まれますがこれに限定されません)が免責されます。

    責任の制限

    法律によって認められる最大限の範囲において、ロロ・ピアーナはお客様又は第三者に対して本ウェブサイト及び/若しくは本コンテンツ若しくはそこに含まれる情報、又は本ウェブサイトを通して販売される商品の利用から生じた損害について、いかなる場合も責任を負いません。当該責任には以下のものが含まれますが、それらに限定されません。(a)データに対する損失若しくは毀損、(b)お客様の備品に対する損失若しくは損害、(c) 弊社が当該利用規約若しくはお客様に対して負っている法律上の注意義務に違反した場合において、お客様及び弊社の双方が予見できなかった損失若しくは損害、若しくはお客様が弊社に対して通知されなかった損失若しくは損害、又は(d)信頼性のあるアンチウィルスソフトをインストールするなどの損害又は損失に対する合理的な予防をお客様が怠った結果としてお客様に生じた損失又は損害。当該利用規約は、詐欺、重過失その他適用される法令の強行法規として免除又は制限されない責任について免除又は制限をするものではありません。

    一般規定

    当該利用規約につきましては、法令の選択に関するルールに関係なく、イタリア法を準拠法とします。お客様には、本ウェブサイトのご利用又は当該利用規約に関連して生じた紛争についてのすべての請求をミラノ裁判所(イタリア)に対して専属的に行うことに同意していただき、さらに同請求の管轄裁判所をミラノ裁判所とすることに同意していただきます。疑義を避けるため記載いたしますが、当該利用規約はロロ・ピアーナが本ウェブサイトの利用又は当該利用規約に関連して生じた紛争についての請求の管轄権を有する裁判所(ミラノ裁判所(イタリア)を含みますがこれに限定されません)に対して行う権利を除外するものではありません。

     TERMS OF SALE – ORDERS DELIVERED TO EUROPE AND RUSSIA (Updated on 1 September 2017)

    These Terms of Sale set out the terms and conditions that will apply to your purchase of Goods through the Website. Please read these Terms of Sale carefully before placing an Order. By confirming that you have read and accepted these Terms of Sale when you submit an Order through the Website, you confirm your unconditional acceptance.

    Your use of the Website is subject to our “Website Terms of Use”, that you can consult in the Section “Legal” – “Terms of Use of our Website”

    The purchase of Products on the Website is reserved solely for consumers. The term “Consumer” is to be understood as any physical person making purchases for purposes unrelated to their business, commercial, artisanal or professional activity

    In these Terms of Sale “Loro Piana”, “we” and “us” means Loro Piana S.p.A. company subject to the direction and coordination of LVMH Moet Hennessy Louis Vuitton S.E. (France) -, with registered office in Corso Rolandi 10, 13017 Quarona (VC) – Italy, VAT number 01611400027, company Register Number 08075900152, and “you” means you, our valued customer.

    Capitalised terms used in these Terms of Sale shall have the meaning set forth in the “Definition” section of this document.

    These Terms of Sale along with your Order Confirmation constitute the contract between us and you for the supply of Goods. No other terms and conditions shall apply. The contract can’t be modified unless we agree to vary it in writing or by email.

    A copy of these Terms of Sale can be stored electronically or printed by all users of our Website.

     

    DEFINITIONS

    In this document:

    “Consumer Code” means the Italian Legislative Decree No. 206 of September 6, 2005

    “Contract” means the contract between you and us for the sale and purchase of Goods, comprising your Order, our e-mail confirmation of our acceptance of your Order and these Terms of Sale

    “Gift” means any Good that is purchased through the Website for delivery to a different recipient

    “Goods” means the products that we sell on the Website from time to time

    "Loro Piana Store" means any Loro Piana store listed as available for returns on our Website

    “Order” means an order for Goods

    “Order Processing Receipt” means the e-mail Loro Piana will send to you at the time your Order is received by Loro Piana

    “Order Confirmation” means the e-mail Loro Piana will send to you at the time the Goods are shipped confirming shipment of all or part of the ordered Goods

    “Delivery Receipt” means the delivery form listing the Goods shipped. This form is sent along with the Goods

    "Terms of Sale"                means these terms and conditions of sale

    "Website" means our website located at www.loropiana.com

    ORDER AND ACCEPTANCE

    To place an Order you must be 18 years of age or over. You will have to select the Goods on the Website, select colour and size, add the items to your shopping bag, check out, and click on the “SUBMIT ORDER AND PAY” button. Before completing the check-out procedure you will be requested either to register for or log into your personal account.

    Each Order submitted constitutes an offer to purchase Goods from us. Orders are subject to availability and acceptance by us and we may, at any time and at our sole discretion, refuse to accept your Order, including but not limited to cases where:

    - you provided us with incorrect information, including without limitation, insufficient or incorrect payment details, incorrect billing information; insufficient or incorrect shipping address – in this regard, please note we do not ship Goods to P.O. boxes; or fraudulent information;

    - there is an error on the Website relating to the Goods that you have ordered, for example an error relating to the price or description of the Goods as displayed on our Website;

    - the Goods that you have ordered are no longer available through our Website;

    - the amount of the proposed transaction is excessively high, based on our case-by-case evaluation, and subject to our discretion; or- we believe that you are under the age of 18.

    If we are unable to accept your Order, we will contact you at the e-mail address or telephone number that you have provided to us, as soon as possible within 30 days from the date of your Order. If you place an Order by telephone, you will have to register to the Website during the call and provide us with an e-mail address.

    After you have placed your Order through the Website or by telephone, you will receive an Order Processing Receipt that is an e-mail from us confirming that your Order has been received by us and is being processed.

    If you do not receive the Order Processing Receipt within 48 hours of placing the Order, contact us at +39.02.77802800 or by e-mail at customerservice.eu@loropiana.com before you try to place another Order for the same Goods.

    Please note that the Order Processing Receipt does not constitute acceptance of your Order. The acceptance of your Order and the charge of the amount on your credit card or other means of payment you have selected will take place only when we send you the Order Confirmation through which we inform you that your Order has been shipped. Together with the Order Confirmation you will receive as well an e-invoice for your Order. You hereby acknowledge and agree that we reserve the right to accept your Order in whole or in part; therefore, in the event of partial acceptance, your card will be debited and the Goods will be shipped for the part of the Order that was accepted.

    If you have any questions, comments or concerns regarding your Order, or if you think that your Order was rejected by us in error, please contact us at the contact details indicated under Section “CUSTOMER SERVICE” below.

     

    PRODUCT AVAILABILITY

    We will make all reasonable efforts to ensure that the prices and other information about Goods displayed on the Website are accurate and up-to-date. However, the inclusion of any Goods on our Website does not imply, warrant or guarantee that the Goods will be available if you wish to place an Order to purchase them.

    We will have the right, at any time and without previous notice, to make changes to the information about Goods displayed on the Website, including without limitation information about prices, description or the availability of Goods. Changes will not however affect the price, availability or description of any Goods for which you received the Order Confirmation.

    GIFTS

    You may purchase Goods as a Gift and have it sent to a different recipient.

    Please note that you will be liable for providing the recipient’s personal data in compliance with any applicable privacy law. We invite you to consult our Privacy Policy on the Website before providing us with a third party’s personal data.

    We will deliver the Gift to your recipient. You will receive the Order Confirmation from us when your Gift has been shipped to the recipient confirming that we have accepted your Order for the Gift and an e-invoice for your Order.

    PRICES AND PAYMENTS

    The prices of the Goods are indicated on the Website and will be confirmed in the Order check-out page, in the Order Confirmation as well as in the e-invoice you receive after your purchase. We reserve the right to vary the price of our Goods at any time, provided that we will not alter the price of any Goods after we send you the Order Confirmation. Please be aware that prices charged for any Goods purchased on the Website may vary to reflect local market pricing and applicable duties.

    All prices except for Japan and the USA pricelists are inclusive of VAT, as applicable. An additional 20% fee inclusive of any applicable sales taxes shall apply only for sales to users connecting to the Website with Japan and USA IP addresses. Any other taxes and duties are not included and are calculated according to the value of your Order and your shipping destination and are itemized on the Order check-out page, in the Order Confirmation as well as in the e-mailed invoice. Shipping costs may also apply to your Order and will be indicated in the Order check-out page.

    You may pay by credit card or bank wire transfer (this latter only for Orders to be delivered in the European Union and save for possible restrictions provided by the applicable laws and regulations), as listed on our check-out page. Payment must be made in the currency as indicated on your Order before you submit it.

    Please be advised that you may sustain some extra charges imposed by your credit card issuer or by your bank, for which we deny any responsibility.

    Payment by credit card. You must supply your card details when you place your Order. We will place a “hold” on your payment card for the total value of your Order. If the “hold” on your card has been authorised by your bank, your credit card will be debited for the total value of the Order Confirmation at the time the Goods are shipped to you. We will not accept your Order, neither will we supply the Goods to you until your credit card issuer has authorised the use of your card for payment of the Goods ordered. If we do not receive such authorisation we will notify you. We reserve the right to verify the identity of the credit card holder by requesting appropriate documentation.

    SPECIAL TERMS FOR SHIPMENT TO RUSSIA

    The following special terms apply exclusively to shipments of Goods to Russia:

    - Loro Piana accepts to ship Goods to Russia exclusively for Orders placed by Russian residents that connect to the Website with a Russian IP address;

    - The "Gifts" option is not available for Orders and shipments to Russia;

    - The Orders will be processed only following approval of the custom duties payment by the buyer;

    - Some of the Goods, among which those subject to C.I.T.E.S Treaty, including vicuña items or goods which composition includes fur or exotic leather goods can’t be shipped to Russia. Loro Piana will inform the buyer before the shipping takes place in case some of the goods have to be removed from the Order.

    - In addition to shipping costs, which will be itemized on the Order check-out page and on the Order Confirmation, Orders for Russia may be subject to customs duties which vary depending on the value of the Goods purchased on the Website and which cannot be calculated in advanced by Loro Piana. You will be required to pay such costs directly to the courier at the time the Goods are delivered to you.     - Save for damaged or faulty products, Goods may be returned exclusively according to your right of withdrawal and by using the "Free Pick Up" service. We will not accept returns for changing the color or size of the items already purchased. If you would like a different item, please return your purchase and place a new order. Returns and changes at Loro Piana stores will not be available;

    - In case of return of Goods, using the Loro Piana "Free Pick Up" service, Loro Piana will reimburse exclusively the price you paid for the Goods, minus the original shipping costs. You shall remain responsible for the payment of any customs duties (both for importing Goods in Russia and in Italy);

    - In case of withdrawal and subsequent return of Goods, Loro Piana will reimburse the price you paid for the Goods and the original shipping costs. You shall remain responsible for the payment of any other costs, including costs for returning the Goods and any customs duties (both for importing Goods in Russia and in Italy).

    - In case of damaged or faulty products, the costs for returning the Goods and any customs duties will be borne by Loro Piana.

     

    DELIVERY AND ORDER TRACKING

    International shipping is available when ordering Goods from the Website. You can view the countries to which we ship Goods and from which we accept returns/exchanges directly on our Website.

    We will not deliver any Goods unless or until payment has been authorized and/or credited on Loro Piana's bank account. When the Goods have been consigned to our carrier, we will send you the Order Confirmation.

    Delivery will be made by courier during normal business hours. Please be advised that shipping costs may apply to your Order and that our courier cannot deliver packages without receiving a signature and/or payment of applicable customs duties.

    We will make any reasonable efforts to deliver the Goods within the number of days specified on your Order Confirmation. However, any delivery date or time specified by us is a best estimate only, and we will not be liable for any loss or damage suffered by you through any unavoidable delay in delivery. You can track the progress of your Order by entering the tracking number provided in your Oder Confirmation.

    Goods that we deliver to you will become your property at the time that you receive them. As soon as we have delivered the Goods to you, you will become responsible for them and for any loss or damage to them thereafter.

    Upon delivery of the Goods, and before signing any document attesting delivery, you must carefully check the integrity of the package and, should the package be damaged or altered, you must write in the document attesting delivery that you reserve the right to verify the content. Failure to do so may result in a liability for us, for which you might be held responsible.

    RESALE / RESHIPPING OF OUR MERCHANDISE

    The resale, rental or transfer for commercial or professional reasons of Products purchased on the Site is strictly forbidden. We reserve the right to refuse to accept your Order, if we suspect that you intend to resell our Goods.

     

    HOW DO I RETURN/EXCHANGE AN ITEM?

    The following policy applies only to Goods purchased on our Website. We cannot accept returns/exchanges of Goods purchased on other websites, in physical stores, or Goods from countries where we do not ship merchandise directly.

    Please see the specific applicable conditions below:

     

    A. To Return or Exchange An Item Online Using Loro Piana’s Free Pick Up Service:

    i. Items Purchased By You:

    You may return or exchange the colour or size of any online purchase made by you, within 15 days after the Goods are received. Each item can be exchanged or returned one time only. Please note we only accept exchanges for changing the colour or size of the same item already purchased. If you would like a different item, please return your purchase and place a new order.

    Returning or exchanging purchased Goods using our return service is free and can be done in 3 easy steps:

    1. Please login to your Account. Under “Order History”, you can select the detail page for the relevant Order and indicate the items which you would like to return/exchange as well as the reason for the return or the new colour/size desired. You will receive a Return Authorization Number. Print this number directly from the site (alternatively if you do not have access to a printer, handwrite the Return Authorization Number on the line indicated in the Delivery Receipt that you received with the original shipment).

    2. Place all items for return/exchange new, unused, and in perfect condition with all of the tags and labels attached in their original boxes and packaging along with the Return Authorization Number (printed or handwritten as per the above).

    3. Attach the eCOMMERCE URGENT sticker and the DHL air way bill that you received with the original shipment to the outside of the box. Insert your name, address, and Return Authorization Number on the DHL airway bill. Call DHL directly or visit their website to schedule a free pick up. You will be asked to provide the Loro Piana client code which will appear automatically on your air way bill, and the best time for a pick up.  Return shipments using DHL will be provided to you free of charge.

     

    ii. Items You Received As A Gift:

    Unfortunately, Gifts cannot be returned for a refund using our online process; Gifts can only be exchanged for a different size and/or color within 15 days after the Gift items are received. Each Gift item you receive can be exchanged one time only.

    Please note that when the Goods are returned to us, we will review them for quality control. If the Goods are sent back in perfect condition, new, unused, and with all of the tags and labels attached, we will approve the return and, as the case may be, exchange the Goods or reimburse the total amount paid minus original shipping costs to the card or the bank account used for the original purchase. We will credit the refund to the card or the bank account that you used to pay for the Goods within approximately thirty (30) days from the date that we receive the returned Goods, save for possible delays of technical nature not attributable to us (e.g.: malfunctions of the credit card system). In case of payment by wire transfer received from a country outside the European Union, you will be contacted by our Customer Service to obtain all necessary information in connection thereto. You remain responsible for any charge applied by your bank.

    In cases where the Goods appear to be worn or used, are missing any of the labels or tags, do not comply with our Terms of Sale, are sent from countries where we do not ship directly or where we have any reason to believe that the Goods are fraudulent or were not purchased directly on our Website, we will not be able to accept the return/exchange and we will send the original Goods back to you.

     

    B. To Return or Exchange An Item In Our Stores

    As an additional opportunity, Goods purchased on our Website can be returned or exchanged in several Loro Piana Stores within 15 days after the Goods are received. Each item can be exchanged or returned one time only. This policy applies both to online items purchased by you and online items you received as a Gift. To find the Loro Piana Store nearest you that accepts returns or exchanges of Goods purchased online, please refer to the list on our Website (Section “Customer Service” – Returns & Exchanges”) or in the documentation you received with your original order.

    Returning or exchanging purchased Goods in our store is free and can be done in 2 easy steps:

    1. Bring the Goods, in perfect condition, new, unused, and with all of the tags and labels attached, in their original packaging along with the Delivery Receipt that you received in the original shipment to a Loro Piana Store that accepts returns.

    2. A store representative will check the Goods to make sure that they are in perfect condition, new, unused, and with all of the tags and labels attached. If the Goods comply with the standards stated in these Terms of Sale, then:

    2.a. if you wish to exchange the Goods, you will receive the same product in a different colour and/or size.

    Please note that exchanges are only valid for the exact same product in a different colour or size, based on availability in the store; or

    2.b. If you wish to return the Goods, you will be issued a gift certificate for the Goods returned using the price applicable in the store. Please note that the price applicable in the store might be different from the price paid on line (eg currency differences, shipping costs, etc.).Original shipping costs will not be refunded. The certificate will be valid for one year from the date of issue and must be used in the Loro Piana Store where it was issued. Please note that Loro Piana Stores cannot reimburse credit cards, bank accounts or give cash refunds.

    In cases where the Goods appear to be worn or used, are missing any of the labels or tags, do not comply with our Terms of Sale, or where we have any reason to believe that the Goods are fraudulent or were not purchased directly on our Website, we will not be able to accept the return/exchange.

     

    C. Return of damaged or faulty Goods

    You have the right to return Goods for quality problems within the limits set forth by the law and these

    Terms of Sale - provided that we are notified of the quality problems within 2 months from discovery and that you have the Delivery Receipt that you received in the original shipment. This policy applies both to online items purchased by you and online items you received as a Gift. For returns related to quality concerns that occur within 15 days of Goods being received, please follow the procedures outlined above under letters A. - point i. for Goods purchased by you on our Website and point ii. for items you received as a Gift - or B. For returns after 15 days of Goods being received, please contact our Customer Service at customerservice.eu@loropiana.com or +39.02.77802800.

    Please note that when the Goods are returned for quality problems we will examine them. If the Goods have quality problems we will repair them (if possible) or replace them with new Goods. If we are unable to repair or replace the Goods in a timely and satisfactory manner, then:

    - for Goods purchased by you on our Website, we will refund the price paid for the Goods (along with the initial shipping costs and any costs borne by you to return the Goods, provided you provide evidence thereof in writing) to the card or bank account used for the original purchase in accordance with the applicable regulations In case of payment by wire transfer received from a country outside the European Union, you will be contacted by our Customer Service to obtain all necessary information in connection thereto. You remain responsible for any charge applied by your bank;

    - for items you received as a Gift, we cannot issue a refund and our Customer Service will contact you.

    If we reasonably believe that the Goods you have returned to us are not faulty/damaged and do not have quality problems, or have been damaged due to misuse or were shipped to us later than the above mentioned deadline or without the Withdrawal  Form, you will not be entitled to a refund and/or repair and/or exchange and we will return the original Goods to you.

     

    D. To Return An Item Enforcing Your Right of Withdrawal

    This option is available only for online items purchased by you and not for online items you received as a

    Gift. To return purchased Goods enforcing your statutory right of withdrawal you should follow the below procedure, to be started within 15 days after the Goods are received:

    1. Notify us in writing that you wish to return purchased Goods enforcing your right of withdrawal. You can either send an e-mail to our Customer Service at customerservice.eu@loropiana.com or write us at Loro Piana S.p.A. – eCOMMERCE Customer Service - Via per Valduggia, 22 - 13011 Borgosesia (VC) Italy, providing an email and phone number where we can reach you. Alternatively you can fill in and send us the Withdrawal Form available on the following link [https://www.loropiana.com/media/legal/Loro_Piana_SpA_Withdrawal_Form_ENG.pdf]. We will then contact you and provide you with a Return Authorization Number. Handwrite the Return Authorization Number on the line indicated on the original Delivery Receipt that you received with the original shipment.

    2. Place all items for return new, unused, and in perfect condition with all of the tags and labels attached in their original boxes and packaging along with the Return Authorization Number handwritten as per above.

    3. Attach the eCOMMERCE URGENT sticker that you received with the original shipment to the outside of the box.

    4. Arrange for return of the purchased Goods to us at the following address: Loro Piana S.p.A., Via per Valduggia 22, 13011 Borgosesia (VC) – Italy. Please specify that the shipment is made to the attention of “E-Shop Returns.” Goods shall be shipped to us within 14 days from the day on which you have communicated your decision to withdrawn from the contract as per point 1. above. Please be advised that you are responsible for the return shipping and possible damages and loss occurred while returning Goods until we receive them, so you may prefer to use a reliable delivery means that provides tracking and insurance services.

    The amount reimbursed will be the total amount paid, including the original shipping costs. Please note that we will not reimburse any return shipping costs.

    Please note that when the Goods are returned to us, we will review them for quality control.     We will not be liable to you under the Contract for any loss of profit, loss of income, loss of business, loss of revenue or loss of goodwill; any loss or corruption of or damage to data; or any loss or damage which was not a reasonably foreseeable result of either our breach of the Contract or our breach of our legal duty of care. Loss or damage is “reasonably foreseeable” if, at the time that we and you entered into the Contract, such loss was either contemplated by us and you or you notified us that the loss may occur if we breached the Contract or our legal duty of care.

     

    GENERAL TERMS

    (a) These Terms of Sale and the Contract between you and us is governed by the law of Italy. Either you or we may bring legal actions in respect of any dispute which arises in connection with the Contract only in the court of Milan (Italy) or the competent court of your habitual place of residence or domicile, as applicable.

    (b) If either you or we do not enforce or delay enforcing any of our rights under the Contract, this will not stop us from doing so at a later date.

    (c) If any provision of these Terms of Sale is not valid or legally enforceable, that term will be deleted and the remaining terms will not be affected.

    ORDER AND ACCEPTANCE

    To place an order you must be at least 18 years of age and by placing an order you represent that you are at least 18 years of age.  To place an order, you will have to select the products on the Site you wish to purchase, select their color and size, add the items to your shopping bag, check out, and click on the “SUBMIT ORDER AND PAY” button.  Before completing the check-out procedure you will be requested either to register for, or log into, your personal account.  You are responsible for maintaining the confidentiality of your password and restricting access to your password and account.  You agree to accept responsibility for all purchases and activities that occur under your account.

    Your placement of an order does not necessarily assure that we will accept your order.  Orders are subject to acceptance by us and we may, at any time and at our sole discretion, refuse to accept your order, including but not limited to cases where:

    1. you provided us with incorrect or false information, including without limitation, insufficient or incorrect payment or billing information, or insufficient or incorrect shipping address (in this regard, please note we do not ship products to P.O. boxes);
    2. there is an error on the Site relating to the products that you have ordered, for example an error relating to the price or description of the products as displayed on our Site;
    3. the products that you have ordered are no longer available through our Site;
    4. the amount of the proposed transaction is excessively high, based on our case-by-case evaluation, and subject to our discretion; or

    Any taxes and duties are not included and are calculated according to the value of your order and your shipping destination.  If you placed your order from an Internet Protocol address originating in the United States, any such taxes and duties will be itemized on the order check-out page, the Order Confirmation, and the e-mailed invoice.  However, if you placed your order from an Internet Protocol address outside of the United States, any such taxes and duties – along with a possible handling surcharge - will be bundled on the order check-out page and the Order Confirmation, and will be itemized only on the e-mailed invoice. 

    All shipping charges are your responsibility, unless waived by Loro Piana.  Shipping charges will be calculated and displayed on the Site prior to finalizing your order.  Shipping charges are subject to change without notice. 

    Loro Piana accepts payment only using the credit cards listed on our check-out page.  All transactions on the Site are processed using a secure online payment gateway that encrypts your card details in a secure host environment.  By submitting your order, you represent and warrant that you are authorized to use the designated credit card and authorize us to charge your order (including taxes, shipping and handling) to that card.  If the card cannot be verified or is invalid or is otherwise not acceptable, your order may be suspended or cancelled automatically. 

    You must supply your card details when you place your order.  We will place a “hold” on your payment card for the total value of your order.  If the “hold” on your card has been authorized by your bank, your credit card will be debited for the total value of the Order Confirmation at the time the products are shipped to you.  We will not accept your order or ship the products to you until your credit card issuer has authorized the use of your card for payment of the products ordered.   If we do not receive such authorization we will notify you by e-mail.  We reserve the right to verify the identity of the credit card holder by requesting appropriate documentation.  After a “hold” on your payment card has been authorized by your bank, please be advised that, in case your credit card is debited for a lower amount than the total amount “held”, it is possible that the balance will not immediately be fully available to you for reasons beyond our control (e.g., delays by your credit card issuer in removing the “hold” from your credit card).

    Please note that Loro Piana is not responsible for any fees imposed by your credit card company, such as currency conversion fees.  

    If you intend to dispute the validity or amount of any charge that appears on your credit card statement with your credit card company, we encourage you to first contact our customer service department to determine if we can address any concerns that you may have.

    DELIVERY AND ORDER TRACKING

    We will not deliver any products unless and until payment has been authorized and debited.  When the products have been consigned to our carrier,  we will send you the Order Confirmation.

    Delivery will be made by courier during normal business hours. Please be advised that delivery charges may apply to your order and that our courier cannot deliver packages without receiving a signature.

    We will make any reasonable efforts to deliver the products within the number of days specified on your Order Confirmation. However, any delivery date or time specified by us is an estimate only, and we will not be liable for any loss or damage suffered by you through any unavoidable delay in delivery. You can track the progress of your order by entering the tracking number directly into our carrier’s website.

    Risk of loss to products shall pass to you upon delivery of such products.  Title to products shall pass from Loro Piana to you upon the later of (i) the date of delivery of such products, or (ii) the date on which we receive payment in full for such products.   As soon as we have delivered the products to you, you will become responsible for them, and for any loss or damage to them thereafter.  Upon delivery of the products, and before signing any document attesting delivery, you must carefully check the integrity of the package.

    RESALE / RESHIPPING OF OUR MERCHANDISE

    You must not misrepresent yourself as being one of our authorized resellers or as being qualified to resell our products. We reserve the right to refuse to accept your order, if we suspect that you intend to resell our products.

    RETURN AND EXCHANGE POLICY

    The following policy applies only to products shipped to any state within the U.S., including Alaska and Hawaii, that are purchased from the U.S. Loro Piana entity.  These terms do not apply if such products were purchased (i) for shipment to any other jurisdiction, (ii) at a physical store location (including, without limitation, any Loro Piana store), or (iii) through other websites.  We will not accept returns/exchanges of products purchased through such other means.

    A.        To Return or Exchange An Item Online Using Loro Piana’s Free Pick Up Service:

    1.         Items Purchased By You:

    You may return for a refund or exchange any items purchased through the Site for any reason within fifteen (15) days after the items are received.

    Please note we only accept exchanges for changing the color or size of the same item already purchased.  If you would like a different item, please return your purchase for a refund and place a new order.     

    Returning or exchanging purchased products using our return service is free and can be done in 3 easy steps:

    a.         Login to your Account.  Under “Order History”, you can select the detail page for the relevant order and indicate the items which you would like to return/exchange as well as the reason for the return or the new color/size desired.  You will receive a Return Authorization Number ("RAN").  Print the RAN directly from the site (alternatively, if you do not have access to a printer, handwrite the RAN on the line indicated in the delivery form that you received with the original shipment ("Delivery Receipt")).

    b.        Place all items for return/exchange new, unused, and in the same condition in which you received the item, with all of the tags and labels attached in their original boxes and packaging along with the RAN (printed or handwritten as per the above).

    c.         Attach the eCOMMERCE URGENT sticker and the pre-addressed FedEx air way bill that you received with the original shipment to the outside of the box. Call FedEx directly or visit their website to schedule a free pick up. Return shipments using FedEx will be provided to you free of charge.

    IF YOU HAVE REQUESTED A REFUND, WE WILL REFUND YOU THE PRICE PAID FOR THE PRODUCT AND APPLICABLE TAXES (EXCLUDING ANY TAXES THAT MAY HAVE BEEN ASSESSED ON SHIPPING AND HANDLING).  HOWEVER, WE CANNOT REFUND YOU THE ORIGINAL SHIPPING FEES YOU PAID, ANY APPLICABLE HANDLING SURCHARGE YOU PAID, OR TAXES ASSOCIATED WITH SUCH CHARGES.

    IF, IN OUR SOLE DISCRETION, WE BELIEVE THAT THE NUMBER OF EXCHANGES YOU MAKE ARE EXCESSIVE, WE RESERVE THE RIGHT TO PROVIDE YOU WITH A REFUND AND TO REFUSE TO PROVIDE YOU WITH FURTHER EXCHANGES.

    2.         Items Received As A Gift:

    You may return or exchange any items received as a Gift for any reason within fifteen (15) days after the items are received.

    Please note we only accept exchanges for changing the color or size of the same item already purchased. 

    For a Gift return or exchange you should contact our customer service either by email at customerservice.us@loropiana.com or by phone at (212) 652-1650 or toll free at (855) 481-9100 to receive a RAN and then follow the steps A(1)(b)-(c) above.

    IF YOU RETURN AN ITEM, ONLY THE ORIGINAL PURCHASER WILL BE ENTITLED TO RECEIVE A REFUND. THIS REFUND WILL BE LIMITED TO THE PRICE PAID FOR THE PRODUCT AND APPLICABLE TAXES (EXCLUDING ANY TAXES THAT MAY HAVE BEEN ASSESSED ON SHIPPING AND HANDLING).  WE CANNOT REFUND THE ORIGINAL SHIPPING FEES, ANY APPLICABLE HANDLING SURCHARGE PAID BY THE ORIGINAL PURCHASER, OR TAXES ASSOCIATED WITH SUCH CHARGES.

    IF, IN OUR SOLE DISCRETION, WE BELIEVE THAT THE NUMBER OF EXCHANGES YOU MAKE IS EXCESSIVE, WE RESERVE THE RIGHT TO PROVIDE THE ORIGINAL PURCHASER WITH A REFUND AND TO REFUSE TO PROVIDE YOU WITH FURTHER EXCHANGES.

    Please note that when the products (whether purchased by You or received as a Gift) are returned to us, we will review them for quality control.  If the products are sent back in their original, new, and unused condition, and with all of the tags and labels attached, we will approve the return and, as the case may be, exchange the products or reimburse the total amount paid and applicable taxes minus original shipping and handling costs (including any taxes associated with such charges) to the card used for the original purchase.  We will credit the refund to the card used to pay for the products within approximately thirty (30) days from the date that we receive the returned products, save for possible delays of technical nature not attributable to us (e.g., malfunctions of the credit card system).

    In cases where the products appear to be worn or used, are missing any of the labels or tags, do not comply with our Terms of Sale, or where we have any reason to believe that the products are fraudulent or were not purchased directly on our Site, we will not be able to accept the return/exchange and we may send the original products back to you.

    B.        To Exchange An Item In Our Stores

    Products purchased on our Site, including products received as Gifts, (i) can be exchanged by the recipient at select Loro Piana stores that are listed as available for returns on our Site ("Loro Piana Stores"), or (ii) can be returned for a store credit, which is only valid in the Loro Piana Store where such store credit is issued. Both options are available up to fifteen (15) days after the products are received. PLEASE NOTE THAT LORO PIANA STORES CAN NOT OFFER A REFUND FOR ITEMS PURCHASED THROUGH THE SITE.  TO RECEIVE A REFUND, PLEASE USE THE PROCESS DESCRIBED IN SECTION A (ABOVE).

    To find the Loro Piana Store nearest you that accepts returns or exchanges of products purchased online, please refer to the list on our Site under “Customer Service – Returns & Exchanges” section or in the documentation you received with your original order.

    Returning or exchanging purchased products in our store is free and can be done in 2 easy steps:

    1.         Bring the products, in their original, new, unused condition, and with all of the tags and labels attached, in their original packaging along with the Delivery Receipt and e-invoice that you received in the original shipment to a Loro Piana Store that accepts returns.  

    2.         A store representative will check the products to make sure that they are in acceptable condition, new, unused, and with all of the tags and labels attached.  If the products comply with the standards stated in these Terms of Sale, then:

    a.         If you wish to exchange the products, you will receive the same product in a different color and/or size. Please note that exchanges are only valid for the exact same product in a different color or size, based on availability in the store; or

    b.        If you wish to return the products, you will be issued a store credit for price paid for the product and applicable taxes (excluding any taxes that may have been assessed on shipping and handling).  The store credit will be valid for one year from the date of issue (except where prohibited by applicable law) and must be used in the Loro Piana Store where it was issued.  PLEASE NOTE THAT THE ORIGINAL SHIPPING FEES YOU PAID, APPLICABLE HANDLING SURCHARGE YOU PAID, OR TAXES ASSOCIATED WITH SUCH CHARGES,  WILL NOT BE TAKEN INTO CONSIDERATION FOR THE CALCULATION OF THE VALUE OF THE STORE CREDIT.

Convention on the International Sale of Goods.  All legal proceedings arising out of or in connection with these Terms shall be brought exclusively in the City of New York, State of New York.

    GENERAL TERMS

    If we fail, at any time during the term of our contract, to insist upon strict performance of any of your obligations under the contract or any of these Terms of Sale, or if we fail to exercise any of the rights or remedies to which we are entitled pursuant to the Terms of Sale, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.  A waiver by us of any default shall not constitute a waiver of any subsequent default.  No waiver by us of any of these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing

    If any provision of these Terms of Sale is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision will be separable from the remainder of the provisions hereof which will continue in full force and effect as if these Terms of Sale had been executed with the invalid provisions eliminated.

    Nothing in these Terms of Sale, express or implied, is intended to confer rights, benefits, remedies, obligations or liabilities on any person other than you and Loro Piana (and its respective successors or permitted assigns).

    These legal terms and conditions ("Terms of Sale"), as amended from time to time, apply to you and your purchase of any products from Loro Piana through the online store website located at www.loropiana.com (the "Site") that are shipped to any province or municipality within the People's Republic of China ("China" or "PRC") excluding Hong Kong and Macau.   In these Terms of Sale “Loro Piana”, “we” “us”, or “our” means Loro  Piana (Shanghai) Commercial Co. Ltd., and “you” or “your” means you, our valued customer.

    Please read these Terms of Sale carefully before placing an order through the Site.  These Terms of Sale are intended to supplement the Site's (i) Terms of Use (which can be viewed on the Site by clicking on the appropriate link), which governs your use of the Site, and (ii) Privacy Policy (which can be viewed on the Site by clicking on the appropriate link), which describes how we use, process and transfer the information that we obtain in connection with your use of the Site and purchase of products through the Site. 

    By placing an order for products through the Site, you confirm that you have read the Terms of Sale in effect at the time of your order, and you agree to be bound by and accept the Terms of Sale in effect at the time of such order.  All sales are expressly conditioned upon your agreement to these Terms of Sale.

    LORO PIANA WILL NOT BE LIABLE FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, COSTS OF COVER, LOSS OF BUSINESS, OR ANY SIMILAR OR OTHER DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY.  TO THE FULLEST EXTENT PERMITTED BY LAW, LORO PIANA'S SOLE AND EXCLUSIVE LIABILITY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE PURCHASE OF PRODUCTS FROM THIS SITE.

    ORDER AND ACCEPTANCE

    To place an order you must be at least 18 years of age and by placing an order you represent that you are at least 18 years of age.  To place an order, you will have to select the products on the Site you wish to purchase, select their color and size, add the items to your shopping bag, check out, and click on the “SUBMIT ORDER AND PAY” button.  Before completing the check-out procedure you will be requested either to register for, or log into, your personal account.  You are responsible for maintaining the confidentiality of your password and restricting access to your password and account.  You agree to accept responsibility for all purchases and activities that occur under your account.

    Your placement of an order does not necessarily assure that we will accept your order.  Orders are subject to acceptance by us and we may, at any time and at our sole discretion, refuse to accept your order, including but not limited to cases where:

    1. you provided us with incorrect or false information, including without limitation, insufficient or incorrect payment or billing information, or insufficient or incorrect shipping address (in this regard, please note we do not ship products to P.O. boxes);
    2. there is an error on the Site relating to the products that you have ordered, for example an error relating to the price or description of the products as displayed on our Site;

    4. the amount of the proposed transaction is excessively high, based on our case-by-case evaluation, and subject to our discretion; or

    If we do not accept your order, we will contact you at the e-mail address or telephone number that you provided to us within thirty (30) days from the date of your order.  If you place an order by telephone you must register with the Site during the call and provide us with an e-mail address.

    Please note that the Order Processing Receipt reflects the processing of your order. You hereby acknowledge and agree that we reserve the right to accept your order in whole or in part; therefore, in the event of partial acceptance and you have chosen to make your payment by credit/debit card, your card will initially be charged the full amount, and then refunded for the part of the order that was not accepted.

    GIFTS

    PRICES AND PAYMENTS

    All prices for products are displayed on the Site and will be confirmed in the order check-out page, in the Order Confirmation, and in the e-invoice you receive after we accept your order.

    We reserve the right to vary the price of our products at any time, provided that we will not alter the price of any products after we send you the Order Confirmation.  Please be aware that prices charged for any products purchased on the Site may vary to reflect local market pricing and applicable duties.

    All prices except for Japan and the USA pricelists are inclusive of VAT, as applicable. An additional 20% fee inclusive of any applicable sales taxes shall apply only for sales to users connecting to the Site with Japan or USA IP addresses. By submitting your order, you represent and warrant that you are authorized to use the designated credit/debit card and authorize us to charge your order (including taxes, shipping and handling) to that card. We will not deliver any products unless and until payment has been authorized and debited.

We reserve the right to verify the identity of the card holder by requesting appropriate documentation. Please be advised that, in case your card is debited for a higher amount than the total amount shipped, we will refund the excess amount to you. It is possible that the returned funds will not immediately be fully available to you for reasons beyond our control (e.g., delays by your card issuer in refunding the charges to your card).

    We take all reasonable care to make the Site secure and to prevent frauds. All transactions on the Site are processed using a secure online payment gateway that encrypts your card details in a secure host environment. Please note that we may, at any time and at our sole discretion, restrict shipping to certain customers and locations.

    If you intend to dispute the validity or amount of any charge that appears on your card statement with your card company, we encourage you to first contact our customer service department to determine if we can address any concerns that you may have.

    B.     Alipay Payment   

    Should You choose Alipay as payment method, You will be redirected to the Alipay website  where the payment will be carried out following the procedure envisaged and regulated by Alipay and the contract terms and conditions as agreed between You and Alipay. You will then be returned to the Site once the payment is completed.

    The data entered on the Alipay website will be handled directly by  Alipay and will not be sent to or shared with Loro Piana. Loro Piana therefore has no knowledge of and cannot record in any way the details of the credit card connected to Your Alipay account or any other payment instrument connected to said account.

    In the event of payment via Alipay, the total amount due will be debited by Alipay to You at the conclusion of the online contract. In the event of the termination of the purchase agreement and for any other type of refund, for any reason, the refund will be credited to Your Alipay account or to the same credit/debit card that You used for the original purchase. The time required to credit the payment instrument connected to said account depends exclusively on Alipay and the banking system. Once the credit order in favour of said account has been arranged, Loro Piana cannot be held responsible for any delays or omissions in crediting You with the refund. To contest these cases You must contact Alipay directly.

    C Cash On Delivery ("COD")

    Loro Piana accepts payment by COD through our courier partner, Federal Express (China) Company Limited ("FedEx"). To be eligible for this service, merchandise must be shipped to an address within the COD service area provided by FedEx .

    The FedEx courier accepts cash payment for all orders with a total value up to 10,000 RMB. Orders with a total value greater than 10,000 RMB may only be paid for with a China Union Pay credit/debit card on the Point Of Sales ("POS") machine brought by FedEx on delivery, or directly at the nearest FedEx service centre where either a China Union Pay credit/debit card or cash is accepted.

    The customer has the right to inspect the package in the presence of the FedEx courier before completing the payment process. By signing the proof(s) of delivery provided by FedEx, you acknowledge that the amount charged and paid and the merchandise is correct. Please note all COD orders must be accepted or rejected in full. If you would only like a portion of the items ordered, you must first accept and pay for all of the items ordered and then follow our return process listed below.

    Refunds for COD will be processed through wire transfer directly to the original purchaser’s bank account. For more details, please read the Return and Exchange Policy section below.

    DELIVERY AND ORDER TRACKING

    When the products have been consigned to our carrier, we will send you the Order Confirmation with the tracking number for your package.

    Delivery will be made by courier during normal business hours. Please be advised that delivery charges may apply to your order and that our courier cannot deliver packages without receiving a signature.

    We will make any reasonable efforts to deliver the products within the number of days specified on your Order Confirmation. However, any delivery date or time specified by us is an estimate only, and we will not be liable for any loss or damage suffered by you through any unavoidable delay in delivery. You can track the progress of your order by entering the tracking number directly into our carrier’s website.

    Risk of loss to products shall pass to you upon delivery of such products.  Title to products shall pass from Loro Piana to you upon the later of (i) the date and (if available) time of delivery of such products, or (ii) the date and (if available) time at which we receive payment in full for such products.  As soon as we have delivered the products to you, you will become responsible for them, and for any loss or damage to them thereafter. Upon delivery of the products, and before signing any document attesting delivery, you must carefully check the integrity of the package. If the external packaging or the merchandise is damaged at time of delivery, please reject the package and note in the proof(s) of delivery the damage. By signing the proof(s) of delivery, you acknowledge that the merchandise and the amount paid is correct.

    RESALE / RESHIPPING OF OUR MERCHANDISE

    You must not misrepresent yourself as being one of our authorized resellers or as being qualified to resell our products. We reserve the right to refuse to accept your order, if we suspect that you intend to resell our products.

    RETURN AND EXCHANGE POLICY

    The following policy applies only to products shipped to any city or municipality within the PRC, excluding Hong Kong and Macau, that are purchased from Loro Piana. These terms do not apply if such products were purchased (i) for shipment to any other jurisdiction, (ii) at a physical store location (including, without limitation, any Loro Piana store), or (iii) through other websites.  We will not accept returns/exchanges of products purchased through such other means.

    Please see the specific applicable conditions below:

    A.        To Return or Exchange An Item Online Using Loro Piana’s Free Pick Up Service:

    1.         Items Purchased By You:

    You may return for a refund or exchange any items purchased through the Site for any reason within seven (7) days after the items are received.

    Please note we only accept exchanges for changing the color or size of the same item already purchased.  If you would like a different item, please return your purchase for a refund and place a new order.     

    Returning or exchanging purchased products using our return service is free and can be done in 3 easy steps:

    a.         Login to your Account.  Under “Order History”, you can select the detail page for the relevant order and indicate the items which you would like to return/exchange as well as the reason for the return or the new color/size desired.  You will receive a Return Authorization Number ("RAN").  Print the RAN directly from the Site (alternatively, if you do not have access to a printer, handwrite the RAN on the line indicated in the delivery form that you received with the original shipment ("Delivery Receipt")).

    b.        Place all items for return/exchange, in their new, unused, and the same condition in which you received the items, with all of the tags and labels attached in their original boxes and packaging along with the RAN (printed or handwritten as per the above).

    c.         Attach the ESHOP URGENT sticker and the pre-addressed FedEx air way bill that you received with the original shipment to the outside of the box. Contact FedEx directly to schedule a pick up. Return shipments using FedEx will be provided to you free of charge.

    IF YOU HAVE REQUESTED A REFUND, WE WILL REFUND YOU THE PRICE PAID FOR THE PRODUCT. WE CANNOT REFUND YOU THE ORIGINAL SHIPPING FEES YOU PAID, ANY APPLICABLE HANDLING SURCHARGE YOU PAID, OR TAXES ASSOCIATED WITH SUCH CHARGES.

    IF, IN OUR SOLE DISCRETION, WE BELIEVE THAT THE NUMBER OF EXCHANGES YOU MAKE ARE EXCESSIVE, WE RESERVE THE RIGHT TO PROVIDE YOU WITH A REFUND AND TO REFUSE TO PROVIDE YOU WITH FURTHER EXCHANGES.

    2.         Items Received As A Gift:

    You may return or exchange any items received as a Gift for any reason within seven (7) days after the items are received.

    For a COD return or exchange you should contact our customer service either by email at customerservice.cn@loropiana.com or by phone at +86 (0)21 52986377 or toll free at 4008 568 580  to receive a RAN and then follow the steps A(1)(b)-(c) above.  

    The customer service will require your bank details to process the refund through wire transfer. If you paid by card, the bank details must match the details of the card originally used for the purchase.

    IF YOU RETURN AN ITEM, ONLY THE ORIGINAL PURCHASER WILL BE ENTITLED TO RECEIVE A REFUND. THIS REFUND WILL BE LIMITED TO THE PRICE PAID FOR THE PRODUCT.  WE CANNOT REFUND THE ORIGINAL SHIPPING FEES, ANY APPLICABLE HANDLING SURCHARGE PAID BY THE ORIGINAL PURCHASER, OR TAXES ASSOCIATED WITH SUCH CHARGES.

    Please note that when the products (whether purchased by You, received as a Gift, or purchased using the COD service) are returned to us, we will review them for quality control. If the products are sent back in their original, new, and unused condition, and with all of the tags and labels attached, we will approve the return and, as the case may be, exchange the products or refund the total amount paid minus original shipping and handling costs (including any taxes associated with such charges) to the card or the bank account used for the original purchase. We will credit the refund within approximately one hundred and eighty (180) days from the date that we receive the returned products, save for possible delays of technical nature not attributable to us (e.g., malfunctions of the credit card system).

    In cases where the products appear to be worn or used, are missing any of the labels or tags, do not comply with our Terms of Sale, or where we have any reason to believe that the products are fraudulent or were not purchased directly on our Site, we will not be able to accept the return/exchange and we may send the original products back to you.

    B.        To Exchange An Item In Our Stores

    Products purchased on our Site, including products received as Gifts, can be exchanged by the recipient at selected Loro Piana stores that are listed as available for returns on our Site ("Loro Piana Stores"). This option is available up to seven (7) days after the products are received. PLEASE NOTE THAT LORO PIANA STORES CANNOT OFFER A REFUND FOR ITEMS PURCHASED THROUGH THE SITE.  TO RECEIVE A REFUND, PLEASE USE THE PROCESS DESCRIBED IN SECTION A (ABOVE).  

    Please note we only accept exchanges for changing the color or size of the same item already purchased.

    To find the Loro Piana Store nearest you that accepts returns or exchanges of products purchased online, please refer to the list on our Site under “Customer Service – Returns & Exchanges” section.

    Exchanging purchased products in a Loro Piana Store is free and can be done in 2 easy steps:

    1.         Bring the products, in their original, new, unused condition, and with all of the tags and labels attached, in their original packaging along with the Delivery Receipt and e-invoice that you received in the original shipment to a Loro Piana Store that accepts returns. 

    2.         A store representative will check the products to ensure that they are in acceptable condition, new, unused, and with all of the tags and labels attached.  If the products comply with the standards stated in these Terms of Sale, then you will receive the same product in a different color and/or size. Please note that exchanges are only valid for the exact same product in a different color or size and are based on availability in the store.

    In cases where the products appear to be worn or used, are missing any of the labels or tags, do not comply with our Terms of Sale, or where we have any reason to believe that the products are fraudulent or were not purchased directly on our Site, we will not be able to accept the return/exchange.

    TAX RECEIPT

    GOVERNING LAW; VENUE

    These Terms of Sale, and any disputes arising out of or relating to these Terms of Sale, shall be governed by the laws of the PRC, without giving effect to its conflicts of law principles and excluding the U.N. Convention on the International Sale of Goods.  All disputes arising out of or in connection with these Terms of Sale, including any dispute regarding the existence, validity or termination of these Terms of Sale, shall be referred and submitted to China International Economic and Trade Arbitration Commission ("CIETAC") and finally settled by arbitration in accordance with the arbitration rules of CIETAC then in force, as modified by the following provisions of this clause. The arbitration shall be conducted in Beijing, PRC. There shall be one (1) arbitrator who shall be jointly appointed by the parties.  In the event no agreement is reached, the Chairman of CIETAC shall appoint the arbitrator. The arbitration award shall be final and binding on the parties, and the parties agree to be bound thereby and to act accordingly.  The costs of arbitration shall be borne by the parties in equal parts during the course of the arbitration and until otherwise decided by the arbitrator.

     

    GENERAL TERMS

    If we fail, at any time during the term of our contract, to insist upon strict performance of any of your obligations under the contract or any of these Terms of Sale, or if we fail to exercise any of the rights or remedies to which we are entitled pursuant to the Terms of Sale, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.  A waiver by us of any default shall not constitute a waiver of any subsequent default.  No waiver by us of any of these Terms of Sale shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

    If any provision of these Terms of Sale is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision will be separable from the remainder of the provisions hereof which will continue in full force and effect as if these Terms of Sale had been executed with the invalid provisions eliminated.

    Nothing in these Terms of Sale, express or implied, is intended to confer rights, benefits, remedies, obligations or liabilities on any person other than you and Loro Piana (and its respective successors or permitted assigns).

    法律上の取引条件(「販売条件」)は、随時改正されるものですが、お客様及びwww.loropiana.com(「サイト」)にあるオンラインショップのウェブサイトを通してお客様ロロ・ピアーナから日本(「日本」)に出荷される製品購入について適用されます。販売条件において、「ロロ・ピアーナ」または「当社」とは、ロロ・ピアーナ ジャパン株式会社を意味し、「お客様」とは、当社の大切な顧客であるお客様を意味します。

     

    サイトを通して注文を行う前に販売条件を注意してください。販売条件は、(i)お客様によるサイトの利用について定めているサイトの利用規約セクション 法的事項をクリックすることによってサイトで閲覧することができます、ならびに、(ii)お客様が行うサイトの利用およびサイトを通した製品の購入に関連して当社が得た情報を当社が使用および処理する方法について記載しているプライバシーポリシーセクション「法的事項」をクリックすることによってサイトで閲覧することができますを補足することを意図したものです

     

    サイトを通して製品の注文を行うことによって、お客様は、お客様の注文時に有効である販売条件を読んだこと、ならびに、当該注文時に有効である販売条件に拘束されることおよびそれを承諾することに同意することをることになります。すべての販売は、販売条件に対するお客様の合意を明示的に条件とします。

     

    お客様が注文を行って、それが当社によって承諾された後に、当社は注文された製品の全部または一部の出荷を確認する電子メール確認「注文確認」をお客様に送ります。お客様の注文確認と併せて販売条件は当該製品の販売に関する当社とお客様との間での契約を構成します。他のいかなる諸条件も適用しないものとします。当社が書面または電子メールにより契約の変更に同意した場合を除き、お客様は契約を修正することはできません。

     

    ロロ・ピアーナは、いかなる時でも、その単独の裁量にて、お客様に対する事前の通知なしに、更新もしくは改正された販売条件へのリンクを掲示することによって、販売条件の一部を変更、修正、改正、追加または削除する権利を留保します。ただし、販売条件に対する当該いかなる変更も、お客様がすでに注文確認を受けた注文には適用しないこととします。お客様が販売条件の変更に同意しない場合、お客様はサイトを通した製品の注文を行ってはいけません。

     

    当社のサイトのすべてのユーザは、販売条件のコピーを電子的に保管するまたは印刷することができます。

     

    免責事項、責任制限

    ロロ・ピアーナは、本サイトにおける情報の正確性もしくは完全性に関して、または、本サイトで販売用として記載もしくは提供されている製品の状態、特徴もしくは入手可能性に関して、いかなる種類の明示的表明も保証もしません。ロロ・ピアーナは、市販性、特定目的への適合性および侵害の黙示保証を含むがこれらに限定されない、いかなる黙示的保証および表明しません。いかなる購入も「現状有姿」であり、お客様自身のリスクになります。サイトを通してお客様が購入した製品または購入しようと試みた製品に関する故障、欠陥、瑕疵または問題に対するお客様の唯一且つ排他的な救済は、以下に記載の当社の返品および交換ポリシーに明示的に定められるものとします。

     

    上記の責任制限は、ロロ・ピアーナが当該損害の可能性について知らされていた場合であっても、本契約に基づく制限的救済によりその最も重要な目的を達成できないかどうかに関係なく、契約、不法行為厳格責任および過失を含みますがこれらに限定されませんまたはその他の法律上の理論から生じたかを問わず、原因の如何を問わず、責任の理論に関係なく、いかなる損失または損害に適用するものとします。

     

    ロロ・ピアーナは、当該損害の可能性について知らされていた場合であっても、逸失利益、費用負担、事業の損失、または類似したもしくは他の損害を含みますがこれらに限定されるものではない、結果的、間接的、付帯的、特別的または懲罰的損害に対して、または第三者による請求に対して、責任を負いません。法律により許容された最大限の範囲まで、ロロ・ピアーナの唯一且つ排他的責任は、本サイトから製品の購入のために実際にお客様が支払った金額に制限されるものとします。販売条件のいずれも、法律によって制限または除外されることができない責任を制限しませんし、除外しません。

     

    注文および承諾

    注文を行うためにはお客様は20歳以上である必要があり、また、注文を行うことによってお客様は自分が20歳以上であると表明することになります。注文を行うために、お客様は、サイトで購入したい製品を選択し、その色とサイズを選択し、その品目を自分のショッピングバッグに追加し、確認し、「すぐに購入して支払う」ボタンをクリックしなければなりません。確認手続を完了する前に、お客様は、お客様の個人アカウントを登録するかまたは個人アカウントにログインするかのいずれかを行うように要請されます。お客様は、自分のパスワードの秘密保持を守ること、ならびにお客様のパスワードおよびアカウントへのアクセスを制限することに対して責任を負うことになります。お客様は、自分のアカウントの下で生じたすべての購入および活動に対する責任を受け入れることに同意します。

     

    お客様が注文を行うことは、当社がお客様の注文を必ず承諾することを保証しません。注文は当社による承諾を条件としており、当社は、いかなる時でも、当社の単独裁量にて、お客様からの注文の承諾を断ることができます。かかる場面は以下の場合を含みますがこれらに限定されません:

     

    1 - 不十分もしくは不正確な支払いもしくは請求情報、もしくは、不十分もしくは不正確な送付先住所(この点に関して、当社は私書箱に製品を出荷しないのでご了承ください)を含みますがこれらに限定されるものではない、不正確もしくは虚偽の情報を、お客様が当社に提供した場合、

    2 - 例えば当社のサイトに表示されている製品の価格または説明に関する誤りなど、お客様が注文した製品に関してサイトに誤りがある場合、例えば当社のサイトに表示されている製品の価格または説明に関する誤りがある場合

    3 - お客様が注文した製品が、当社のサイトを通してもはや入手可能でない場合、

    4 - 当社のケース・バイ・ケースの評価に基づ且つ当社の自由裁量に従い、提案された取引金額が極端に高い場合、または

    5 - 当社が、お客様は20歳未満であると確信する場合。

     

    当社がお客様の注文を承諾しない場合、当社は、お客様の注文日から30日以内に、お客様が当社に提供した電子メールアドレスまたは電話番号を使って、お客様に連絡することとします。

     

    お客様がサイトを通して行った注文を当社が受けた後に、お客様は、お客様の注文を当社が受領して処理されていることを確認する電子メールを当社から受け取ることになります(「注文処理レシート」)。お客様が注文を行ってから48時間以内に注文処理受け取りを受領しない場合、お客様が同じ製品に対して別の注文を行う前に、+81 (0)3 6228 5077に電話をするかまたは customerservice.jp@loropiana.com に電子メールを送ってください。

     

    注文処理レシートはお客様の注文の処理を反映しているのであって、それは必ずしもお客様の注文の承諾を構成するというわけではないことをご了承ください。お客様の注文が当社によって承諾され、お客様が注文した製品を当社が出荷する時にお客様のクレジットカードは請求を受けて、そのときに当社はお客様の注文に関する注文確認と電子請求書「電子請求書」をお客様に送付します。お客様は本書面をもって、当社が全部であるか一部であるかを問わずお客様の注文を承諾する権利を留保することを承認して同意することになります。従って、部分的な承諾が生じた場合、承諾した注文の部分に対して、お客様のカードは請求を受け、製品が出荷されることになります。

     

    お客様が自分の注文に関して質問、コメントもしくは懸念がある場合、または、当社はお客様の注文を誤って却下したとお客様が考える場合、以下の「カスタマー・サービス」というタイトルのセクションに記載される連絡先を使用して、当社に連絡ください。

     

    製品入手可能性

    当社は、正確な価格設定、入手可能性およびサイトに表示される製品に関する他の情報を保持するために合理的な努力をする一方、お客様がそれらを購入するために注文を希望する場合に、当該情報は製品が入手できることを保証しません。

     

    当社は、いかなる時でも、製品の価格、説明または入手可能性に関する情報を含みますがこれらに限定されるものではない、サイトに表示される製品に関する情報を変更する権利を有し、また当社はお客様に事前通知をすることなく当該変更を行うことができます。ただし、変更は、お客様が注文確認を受領した製品の価格、入手可能性または説明に影響を与えないこととします。

     

    ギフト

    お客様は、自分自身以外の受取人へ引き渡すために製品を購入することができます「ギフト」

     すべての適用可能なプライバシー法に従って受取人の個人データを提供することはお客様の責任であることご留意ください。

     

    当社がお客様の注文を承諾した場合、お客様は、当社が受取人にお客様のギフトを出荷した時に当社からの注文確認を受領して、お客様の注文に関する電子請求書を受領することになります。

     

    価格および支払い

    製品のすべての価格はサイトに表示されて、注文確認ページ、注文確認、および当社がお客様の注文を承諾した後にお客様が受領した電子請求書にて、確認されることになります。

     

    当社は、いかなる時でも当社の製品の価格を変更する権利を留保します。ただし、当社がお客様に注文確認を送付した後には製品の価格は変更しません。サイトで購入された製品に対して請求される価格は、現地市場の価格設定および適用すべき関税を反映するために変わる場合があることにご留意ください。

     

    税金および関税は含まれ、それらはお客様の注文価格およびお客様の輸送目的地に従って算出されます。お客様が日本国内にて創設されたIPアドレスから注文を行った場合、当該税金および関税は、注文確認ページ、注文確認、および電子メールで送られる請求書に項目別に示されることとします。ただし、お客様が日本国外のIPアドレスから注文を行った場合、当該税金および関税は、可能性がある取扱追加料金に加えて注文確認ページおよび注文確認ではまとめて記載されることとし、電子メールで送られる請求書にのみ項目別に示されることとします。送料は無料です。送料は予告なく変更される場合があります。

     

    A. オンラインでのクレジットカード支払い

     

    ロロ・ピアーナは、当社の確認ページに記載されるクレジットカードを使用した支払いのみ承認します。サイトにおけるすべての取引は、安全なホスト環境でお客様のカードの詳細を暗号化している、安全なオンラインでの支払のためのゲートウェイを使用して処理されます。お客様の注文を提出することによって、お客様は指定されたクレジットカードを使用する権限を付与されていること、および、お客様は当社がお客様の注文(税金、送料および手数料を含む)をそのカードに対して請求することを許可したことを、表明し保証します。カードを照合することができない、もしくは、カードは無効である、または、カードがその他の理由により承認不可能である場合、お客様の注文は自動的に停止または取り消される場合があります。

     

    お客様が注文を行った時に、お客様は、自分のカードの詳細を提供する必要があります。お客様の注文の合計価格により、当社はお客様の支払いカードを「保留」にすることがあります。お客様のカードの「保留」が、お客様の銀行によって認可された場合、お客様のクレジットカードは、製品がお客様に出荷された時に注文確認の合計価格に対して引き落としされることになります。お客様のクレジットカード発行者が注文された製品の支払いに対するお客様のカードの使用を認可するまで、当社はお客様の注文を承諾せず、お客様に製品を出荷しません。当社が当該認可を受けない場合、当社は電子メールによってお客様に通知します。当社は、適切な文書を要請することによってクレジットカード所持者の身元を検証する権利を保有します。お客様の支払いカードの「保留」がお客様の銀行によって認可された後に、お客様のクレジットカードが「保留」された金額より安い金額で引き落とされる場合でも、当社がコントロールできない理由で、お客様は残額をただちに全額利用できないということがあり得ることをご承知おきください例えば、お客様のクレジットカード発行者がお客様のクレジットカードから「保留」を取り消す際の遅延

     

    ロロ・ピアーナは、通貨の両替手数料などのお客様のクレジットカード会社によって課される料金に対して責任を負わないことをご了承ください。

     

    お客様が、お客様のクレジットカード会社に対してクレジットカード明細表に記載されている請求の有効性または金額に異議を唱える意向がある場合、当社は、お客様が有する懸念に当社が対処することができるかどうか決定するために、最初に当社のカスタマー・サービス部に連絡することを勧めます。 

     

    引渡しおよび注文追跡

    当社は、支払いが認されて引き落とされるまで、製品を引き渡しません。製品が当社の運送業者に委託された後、当社は、お客様にお客様の小包みの追跡番号が付いた注文確認を送付します。

     

    引渡しは、通常の営業時間中に宅配便業者によって行われます。当社の宅配便業者は、署名を受け取ることなく小包みを引き渡すことはできないことをご承知おきください。

    当社は、お客様の注文確認に定められる日数内に製品を引き渡すために合理的な努力を尽くします。しかしながら当社によって定められた引渡しの日付または時間は予測にすぎず、やむを得ない延着によってお客様が被った損失または損害に対して当社は責任を負いません。お客様の注文確認に記載される追跡番号を直接当社の運送業者のウェブサイトに入力することによってお客様の注文の進捗状況を追跡することができます。

     

    製品に対する危険負担は当該製品の引渡し時にお客様に渡るものとします。製品に対する所有権は、(i)当該製品の引き渡した日付、または(ii)当社が当該製品の支払いを全額受領した日付のいずれかのうち遅い方が生じた日付に、ロロ・ピアーナからお客様に渡るものとします。当社が製品をお客様に引き渡した直後に、お客様はそれらに対して責任を負うようになり、その後それらへの損失または損害に対して責任を負うようになります。製品の引渡し後、引渡しを証明する文書に署名する前に、お客様は小包みの完全性を慎重に点検しなければなりません。引渡し時に外側の包装または商品が損害を受けていた場合は、小包みを受け取らずに、引渡し証明書に損害について記載してください。引渡し証明書に署名することによって、商品および支払った金額が正しいとお客様が承認したことになります。

     

    当社の商品の再販売/再出荷

    お客様は、お客様自身を、権限を付与された当社の再販業者のうちの1人であるとして、または当社の製品を再販売する権限与えられているとして、偽って伝えてはなりません。お客様当社の製品を再販売する意向があると当社が疑わしく思う場合、当社はお客様の注文の承諾拒否する権利を留保します。

     

    返品および交換についての方針

    以下の方針は、日本に出荷された製品で且つロロ・ピアーナの日本法人から購入されるものに対してのみ適用されます。これらの条件は、当該製品が(i)他の管轄への出荷に対するもの、(ii)物理的な店舗でのご購入ロロ・ピアーナの店舗を含みますがこれに限定されませんまたは(iii)他のウェブサイトを介して購入には適用されません。当社は、当該その他の手段によって購入される製品の返品/交換を受け入れないこととします。

     

    以下の特定適用条件を参照してください

     

    A. ロロ・ピアーナの無料引き取りサービスを利用したオンラインでのアイテムの返品または交換

     

    1. お客様が購入したアイテム

    お客様は、サイトを介して購入したアイテムに関して、理由の如何を問わず、アイテムを受領してから15日以内に、払戻金で返品するかまたは交換することができます。

     

    既に購入したものと同じアイテムの色またはサイズの変更のための交換のみを当社が受け入れることにご留意ください。お客様が異なるアイテムを希望される場合、お客様の購入物を払戻金にて返品した後に、新しく注文を行ってください。

     

    購入された製品の返品または交換は当社の返品サービスを利用すれば無料であり、次の3つの簡単なステップで行うことが可能です

     

    a. お客様アカウントへログインします。「オーダー履歴」において、お客様は関連する注文についての詳細ページを選択し、お客様が返品/交換したいアイテム及び返品理由または希望する新しい色/サイズを指示することができます。お客様は、返品承認番号RANを受領します。サイトからRANを直接印刷してください。あるいは、お客様がプリンタへのアクセスがない場合、最初の出荷で受領した納品フォーム「納品受領証」に示された線の上にRANを手書きしてください。

     

    b. 返品/交換を行うには、すべてのアイテムについて、受け取り時と同じ新品で未使用の状態のまま元々の箱および包装についていたすべてのタグおよびラベルをそのままにし、RAN上記に従って印刷されたかまたは手書きのものと共に梱包してください。

     

    c. Eショップ至急便ステッカー、および、お客様が最初の出荷で受領した予め宛名の記された宅配便業者の航空貨物運送状を箱の外側に添付してください。無料引き取りの予定を入れるには、宅配便業者に直接電話をするか、または、宅配業者のウェブサイトを訪問してください。宅配便業者を使用しての出荷返品は無償でお客様に提供されます。

     

    返金を要求される場合、当社は、製品および適用税に対して支払われた価格送料および手数料に賦課された可能性のある税金を除きますをお客様に返金します。しかし、当社はお客様が支払った該当する取扱いサーチャージまたは当該料金関連した税金をお客様に返金することはできません。

     

    もし、当社の単独裁量にて、お客様の交換数が過剰であると当社が考える場合、当社は、お客様に返金を提供する権利を留保し、お客様が行う更なる交換を提供することを拒否する権利も留保します。

     

    製品が磨耗したり、使用されたり、ラベルやタグが見つからない場合、当社の販売条件に従っていない場合、また、製品が不正であるかもしくは当社サイトから直接購入されたものではないと思われる理由がある場合は、当社は、返品・交換を受け入れることができず、元々の製品をお客様に返却することがあります。

     

    2. ギフトとして受領されたアイテム

    ギフトとして受領されたアイテムは、理由の如何を問わず、アイテムが受領されたあと15日以内にお客様は返品または交換することができます。

     

    当社が受け入れることができるのは、既に購入したものと同じアイテムの色またはサイズの交換のみであることにご留意ください。

     

    ギフトの返品または交換については、電子メールであればcustomerservice.jp@loropiana.com、電話であれば+81 (0)3 6228 5077もしくはフリーダイヤルにて、当社のカスタマー・サービスまでご連絡の上、RANを受領し、上記のA(1)(b)-(c)のステップに従ってください。

     

    アイテムを返品する場合、最初の購入者のみ返金を受領する権利があります。当該返金は、製品および適用税に対して支払われた価格に限定されるものとします送料および手数料に賦課された可能性のある税金を除きます。当社は、最初の購入者が支払った該当する取扱いサーチャージまたは当該料金と関連した税金をお客様に返金できません。

     

    もし、当社の単独裁量にて、お客様の交換数が過剰であると当社が考える場合、当社は、最初の購入者に返金する権利を留保し、お客様が行う更なる交換を提供することを拒否する権利も留保します。

     

    製品お客様が購入したものであるかギフトとして受領されたものであるかを問いませんが当社に返品されてから、当社は品質管理のための審査を行うことにつきご留意ください。製品が元々の未使用で新しい状態にて付随しているすべてのタグおよびラベルと共に返品された場合、当社は返品を承認し、場合によっては、製品を交換するか、または、支払われた合計金額および適用税金から元々の出荷費用および取扱い手数料当該料金と関連する税を含むを差し引いた金額を最初の購入に使用されたカードに払い戻します。当社は、製品支払に用いられたカードへ、返品された製品を当社が受領した日から約30日以内に返金分を戻します。ただし、当社に起因していない技術的な性質例えば、クレジットカードシステムの故障による遅延の可能性がある場合を除きます。

     

    製品が着用もしくは使用されたかのように見える場合、ラベルもしくはタグのいずれかが欠けている場合、当社の販売条件に従っていない場合、または製品が不正であるもしくは製品が当社サイトで直接的に購入されなかったと信じる理由が当社にある場合、当社は返品/交換の受け入れができず、元々の製品をお客様に返却する場合があります。

     

    B. 当社ストアでのアイテムの交換

    ギフトとして受け取った商品を含み、当社のサイトで購入された商品は、商品を受け取ってから15日以内に、当社サイトに返品可能なロロ・ピアーナのストアとして掲載されているストアにて受取人が交換できますFAQ-Returns & Exchanges」のセクション。ロロ・ピアーナのストアは、サイトを介して購入されアイテムに対する返金は提供できないことをご留意ください。返金を受領するには、セクションA上記に記載されているプロセスを使用してください。

     

    既に購入したものと同じアイテムの色またはサイズの変更のための交換のみを当社が受け入れることにご留意ください。

     

    オンラインで購入された製品の返品または交換が可能な最寄りのロロ・ピアーナ・ストアを見つけるには、当社サイトの「FAQ - RETURNS & EXCHANGES」のセクションかまたは元々の注文でお客様が受領した書類に記載のリストをご参照ください。

     

    購入された製品の当社ストアでの交換は無料であり、次のつの簡単なステップで行うことができます。 

     

    1. 製品を最初の梱包にて最初の未使用の新しい状態にし、付属するすべてのタグおよびラベル、ならびに、最初の出荷で受領した納品受領証および電子請求書と共に、返品を受け入れているロロ・ピアーナ・ストアへ持ち込みます

     

    2. ストア代表者は、製品が受け入れ可能で新しく未使用な状態且つすべてのタグおよびラベルが付属している状態であるか確認するために製品を点検します。製品が本販売条件に規定される標準に従っている場合

     

    a. お客様は、異なる色またはサイズ同じ製品を受け取ります。交換は、ストアでの入手可能性に基づいて、異なる色またはサイズの全く同じ製品についてのみ有効であることにご留意ください

     

     

    製品が着用もしくは使用されたかのように見える場合、ラベルもしくはタグのいずれかが欠けている場合、当社の販売条件に従っていない場合、または製品が不正であるもしくは製品が当社サイトで直接的に購入されなかったと信じる理由が当社にある場合、当社は交換の受け入れができません。

     

    C. 損害を受けたまたは不完全なアイテム

    お客様は、本販売条件に規定される範囲内で品質問題のあるアイテムを返品する権利があります。品質問題に関連した返品については、当社のサイトでお客様が購入したアイテムについては上記A.1、または、ギフトとしてお客様が受領したアイテムについては上記A.2に概説されている手続に従ってください。

     

    タックス・レシート

    タックス・レシートは、お客様が製品を受領してから10日後から60日後までのみ交付可能です。税金受領書を要請するためには、電子メール customerservice.jp@loropiana.com  または電話+81 (0)3 6228 5077でカスタマー・サービスに連絡してください。

     

    カスタマー・サービス

    当社は、サイトの利用に関する質問、注文の実行、製品の追跡、製品の入手可能性、ログイン/登録手続き、ならびに、お客様が当社のサイトおよび/または当社の製品の使用に関連して必要である更なる情報について、顧客支援を行っています。当社のカスタマー・サービスは、日本語および英語で、祝日を除月曜日から金曜日の午後1200分から午後800分までの間、利用可能です。

     

    情報が必要である場合、当社は、お客様に当社のサイトの「FAQセクション」を参照することを勧めます、お客様が満足できない場合、電子メール customerservice.jp@loropiana.com または電話+81 (0)3 6228 5077で当社に連絡することができます。

     

    準拠法、裁判管轄

    販売条件、および販売条件に起因もしくは関連する紛争は、法の抵触に関する原則を除いて、日本法を準拠法としますが、国際物品売買に関する国際連合条約の適用は除外します。条件に起因するまたは関連するすべての法的手続は、専属的に東京地方裁判所に提起されるものとします。

     

    一般条項

    当社の契約期間中いかなる時でも、当社が契約もしくは販売条件の条項いずれかに基づくお客様の義務のいずれかの厳格な履行を強く要求しない場合、または、当社が販売条件に従って得る資格がある権利もしくは救済のいずれかを行使しない場合、このことは当該権利または救済の放棄を構成しないものとし、また当該義務の遵守からお客様を免除しないものとします。不履行に対する当社による権利放棄は、いかなるその後の不履行に対する権利放棄構成しないものとします。条件のいずれかの当社による権利放棄は、それが権利放棄であると明示的に述べられて、お客様に書面により通知されない限り、有効でないものとします。

     

    販売条件の規定が、理由の如何を問わず、管轄裁判所によって無効、違法または実施不可能であると判断された場合、当該規定は、あたかも販売条件が無効な規定を削除して締結されたかのように、完全な効力を維持する本契約の残余の規定と分離可能です。

     

    販売条件のいずれも、明示または黙示を問わず、権利、利益、救済、義務または賠償責任をお客様およびロロ・ピアーナ並びにそのそれぞれの承継人または許可された譲受人以外の個人に与えることは意図しておりません。
